Divorce Arbitration in New Jersey
What Is Divorce Arbitration?
Divorce Arbitration in New Jersey is a process in which the parties who cannot resolve their disputes elect to have them resolved outside of the court system.
Divorce Arbitration Can Be Faster Than Litigation
In New Jersey, filing a Divorce Complaint and going through the entire court process is a long ordeal which requires many court appearances. Although New Jersey Divorce judges work very hard, the fact is that they have many cases to deal with, and it is virtually impossible for them to carve out a continuous block of time to have a trial in any one case. Therefore, there may be several trial dates extending over a period of many months.
The Total Cost of Divorce Arbitration Can Be Less Than Litigation
In a New Jersey Divorce case, the cost of having each party’s lawyer prepare for trial, which requires many hours for each scheduled trial date and the submission of many documents to comply with all of the court’s technical requirements, is sometimes more than the real value of the issues which the Judge will decide.
Although Divorce Arbitration does involve the extra cost of paying the Arbitrator, the total cost may actually be less because the Arbitrator will have the time to focus exclusively on the parties’ case and the parties can agree to waive some of the technical requirements that New Jersey Divorce Judges must follow.
Divorce Arbitration is More Private Than Litigation
Court trials of New Jersey Divorce cases are open to the public and are always recorded. In addition, there may be sensitive issues which the parties do not want even the judge to know. By utilizing Divorce Arbitration, the parties can have all disputed issues resolved and still maintain complete privacy.
